Dutchtest.com is administered by Precision Analytical, Inc. The information provided on the website is designed to support, not replace, the relationship that exists between a patient and his/her health/medical practitioner. Precision Analytical, Inc. is solely responsible for the content development and maintenance of this site.

Returns: Shipping Fees are non-refundable. The original Test Kit, including all contents and the original Test Requisition must be returned to Precision Analytical, Inc. within one year after ordering before any refunds can be issued. Credit Card refunds can take up to 30 days to process. There is $25.00 Restock fee on all returned kits.

 

Additional Terms and Conditions
By agreeing to the Terms and Conditions, I am submitting my health information and ordering tests for informational purposes only. By purchasing a test(s) on dutchtest.com I acknowledge that Precision Analytical Inc. has contracted with a licensed physician only for the sole purpose of authorizing the tests that I am purchasing. I am responsible for taking the test results to my health/medical practitioner for any additional interpretation. I understand that neither the physician authorizing my test, nor Precision Analytical Inc., are diagnosing any condition. Dutchtest.com and Precision Analytical Inc., are not practicing medicine. Dutchtest.com does not direct or control the treatment decisions made by your health/medical practitioner. Dutchtest.com is not liable for any negligent act or omission by your health/medical practitioner.

 

We respect your privacy and do not share, sell or rent any of our customers’ information. You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of a credit card or other content to gain access to Dutchtest.com, its products or services. We reserve the right to make changes to our site, these terms and conditions and/or any policies listed herein at any time and at our discretion. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

 

Any lab services, test results, or products (“lab products”) sold by Precision Analytical Consulting & Laboratory, Inc. (“Precision”) to any party (“Purchaser”) is sold subject to the following terms and conditions, which are the exclusive statement of the applicable terms and conditions. The terms and conditions cannot be amended, supplemented or changed by Purchaser, whether by its purchase order or other means of acceptance, acknowledgment or confirmation.

 

Delivery. Lab products become property of Purchaser upon pickup or delivery to transportation carrier. Precision is not responsible for loss, damage, delay, or any other event while lab products are in transit. In the event any lab products are damaged in transit, Precision shall bear no responsibility and Purchaser must deal directly with the contracted carrier. If Purchaser fails to accept ordered lab products after shipping has been arranged, Precision may add reasonable storage and handling costs to the stated price.

 

Payment Terms. All stated prices are in U.S. dollars. Payment in full of the sale price is due at purchase.

 

Limitations of Remedies. IN NO CASE SHALL PRECISION OR PRECISION’S AFFILIATE AND AGENT BE LIABLE FOR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMTED TO, DAMAGES SUCH AS LOST PROFITS OR COST OF INJURY TO ANY PERSON OR PROPERTY, INCLUDING CLAIMS ARRISING FROM LATENT DEFECTS IN LAB PRODUCTS. UNDER NO CIRCUMSTANCES SHALL PRECISION BE LIABLE FOR ANY AMOUNT GREATER THAN THE PURCHASE PRICE ON THE APPLICABLE ORDER FORM AND INVOICE.

 

Governing Law. This Agreement shall be governed by the laws of the State of Oregon. If any claim or dispute arises, Purchaser agrees to resolve the dispute through the Yamhill County Circuit Court located in Yamhill County, Oregon. Purchaser and Precision agree to submit to the personal jurisdiction and venue of said court. The prevailing party in any litigation or arbitration shall be entitled to recover its reasonable attorneys’ fees and costs, at trial (or hearing) or on appeal.

 

Severability. If any term of this Agreement is to any extent illegal, otherwise invalid, or incapable of being enforced, such term shall be excluded to the extent of such invalidity or unenforceability and all other terms hereof shall remain in full force and effect.
